“Buyer” means a Member that uses the Services as an advertiser or purchaser of advertising services.

“Cookies” means cookies, pixels, tags, SDKs, local storage, tracking URLs, and similar technologies used to recognize, store, access, or transmit information from a browser, device, or system, as further described in our Cookie Policy.

“Member” means any individual or legal entity that registers for, accesses, or uses the Services as a Buyer, Seller, account user, representative, or other authorized user.

“Payment Data” means information relating to payments, deposits, refunds, payouts, invoices, billing, payment methods, payout methods, transaction records, chargebacks, payment disputes, and related financial processing.

“Platform” means the Redtraffic advertising technology platform, dashboard, account interface, reporting tools, ad serving systems, tracking systems, payment and payout functions, APIs, integrations, and related technical services.

“Seller” means a Member that uses the Services as a publisher, seller of advertising inventory, traffic source, placement owner, or provider of Ad Space.

“Sensitive Data” means personal data classified as sensitive, special category, or otherwise specially regulated under applicable privacy laws, which may include government identification data, precise geolocation data, financial account data, biometric data, health data, data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, sex life or sexual orientation, and other categories protected by applicable law.

“Services” means the Website, Platform, advertising technology services, account services, support services, payment and payout processes, compliance checks, fraud-prevention processes, reporting tools, and related services provided by Redtraffic.

“Traffic Data” means technical, device, browser, network, usage, advertising, referral, placement, and interaction data processed in connection with Website visits, ad delivery, traffic sources, campaign delivery, fraud prevention, analytics, reporting, and Platform security.

“User,” “you,” or “your” means any visitor, Member, Buyer, Seller, account user, representative of a business entity, person communicating with Redtraffic, or other individual whose personal data is processed in connection with the Services.

This Privacy Policy does not apply to websites, applications, landing pages, traffic sources, advertisements, payment providers, payout providers, social media platforms, analytics services, or other third-party services that are not owned or controlled by Redtraffic. Such third parties are responsible for their own privacy notices, data practices, security practices, and legal compliance.

Buyers and Sellers are independently responsible for the personal data they collect, use, disclose, or otherwise process through their own websites, applications, advertisements, landing pages, traffic sources, checkout flows, subscription flows, pixels, tags, cookies, tracking technologies, and business operations.

4.5. Redtraffic does not control and is not responsible for the privacy policies, cookie notices, consent mechanisms, tracking practices, data collection practices, security practices, or legal compliance of any Buyer, Seller, advertiser, publisher, website, application, landing page, traffic source, payment provider, or other third party.

4.6. Where a separate privacy notice, cookie notice, data processing agreement, platform policy, or written agreement applies to a specific product, feature, integration, payment method, payout method, or service, that document may supplement this Privacy Policy.

5. PERSONAL DATA WE COLLECT

5.1. The categories of personal data we collect depend on how you interact with Redtraffic, whether you are a Website visitor, Member, Buyer, Seller, account user, payment contact, payout contact, representative of a business entity, or person involved in verification, compliance, support, or business communications.

5.2. We may collect Account Data, including name, business name, company name, job title, role, username, account ID, email address, phone number, communication identifiers, account settings, account status, login history, support history, verification status, and other information associated with your account.

5.3. We may collect Business and Company Data, including company formation details, registered address, business address, billing address, ownership information, beneficial ownership information, director, officer, manager, or representative information, business licenses, tax identification numbers, VAT/GST numbers, and other information relating to a business entity using the Services.

5.4. We may collect Identity and Verification Data, including government-issued identification documents, passport, national ID, driver’s license, proof of address, live photo or selfie verification, payment-method proof, payout-method proof, bank documentation, company documents, invoices, contracts, traffic-source evidence, campaign materials, and other documentation requested for KYC, KYB, fraud-prevention, sanctions/AML screening, tax compliance, payment-provider compliance, or account security purposes.

5.5. We may collect Payment Data and Payout Data, including payment method information, payout method information, billing information, bank account details, payment card information where applicable, wallet addresses, transaction identifiers, invoices, payout statements, deposit records, refund records, chargeback records, payment dispute records, currency information, payment-provider responses, and related financial processing information.

5.6. We may collect Ad Data, including campaign settings, targeting settings, creatives, advertisements, landing page URLs, traffic sources, placements, impressions, clicks, conversions, conversion events, bid data, budget data, campaign performance data, reporting data, optimization data, fraud signals, invalid traffic signals, and other advertising activity processed through or in connection with the Platform.

We may collect Compliance and Risk Data, including sanctions screening results, AML/CTF screening results, fraud-prevention signals, risk scores, payment-provider review information, traffic-quality review information, chargeback information, dispute information, tax documentation, regulatory inquiry records, law-enforcement request records, and internal compliance notes.

5.11. We do not intentionally collect or process Sensitive Data unless it is necessary for verification, compliance, fraud prevention, legal obligations, payment processing, payout processing, security, or where you voluntarily provide it. 6. PURPOSES AND LEGAL BASES FOR PROCESSING PERSONAL DATA

6.5. We may process personal data to process payments, deposits, refunds, payouts, invoices, payout statements, transaction records, payment disputes, chargebacks, reversals, deductions, reserves, currency conversions, tax documentation, and related financial operations.

6.6. We may process personal data to perform identity verification, business verification, beneficial ownership verification, payment-method verification, payout-method verification, KYC, KYB, enhanced due diligence, AML/CTF screening, sanctions screening, fraud prevention, traffic-quality review, compliance review, tax review, and payment-provider or card-network review.

6.7. We may process personal data to detect, prevent, investigate, mitigate, and respond to fraud, invalid traffic, artificial impressions, artificial clicks, bot traffic, malware, phishing, unauthorized access, account misuse, payment fraud, chargeback abuse, multi-account abuse, prohibited content, technical abuse, security incidents, and other unlawful or abusive activity.

6.8. We may process personal data to comply with applicable laws, regulations, court orders, subpoenas, regulatory requests, law-enforcement requests, tax obligations, accounting obligations, audit obligations, sanctions obligations, AML/CTF obligations, payment-provider requirements, card-network rules, and other legal or compliance obligations.

6.9. We may process personal data to protect the rights, property, safety, security, reputation, business interests, legal interests, and Platform integrity of Redtraffic, Members, users, payment providers, service providers, and third parties.

6.10. We may process personal data to communicate with you about the Services, including service messages, account notices, policy updates, compliance requests, verification requests, payment notices, payout notices, refund communications, support responses, security alerts, and administrative messages.

6.11. We may process personal data to send marketing, promotional, product, service, or business communications where permitted by law or where you have provided consent where required. You may opt out of marketing communications by using the unsubscribe mechanism in the communication or by contacting us at help@redtraffic.com. We may still send non-marketing service, legal, security, payment, payout, compliance, and account-related communications.

6.12. We may process personal data for analytics, research, testing, debugging, measurement, product development, service improvement, traffic-quality improvement, fraud-prevention improvement, campaign optimization, reporting accuracy, and operational planning.

6.13. We may process personal data in connection with business transactions, corporate transactions, restructuring, financing, merger, acquisition, sale of assets, transfer of business, platform migration, payment migration, or similar events, subject to applicable law.

6.14. Depending on your location and the applicable law, our legal bases for processing may include performance of a contract, steps taken before entering into a contract, compliance with legal obligations, legitimate interests, consent, protection of vital interests, public interest, establishment or defense of legal claims, and other lawful bases recognized by applicable law.

6.16. Where processing is based on consent, you may withdraw your consent at any time by using the available consent mechanism or contacting us at help@redtraffic.com. Withdrawal of consent does not affect processing that occurred before withdrawal or processing based on another lawful basis.

7. HOW WE SHARE PERSONAL DATA

7.1. We may disclose personal data where necessary or appropriate to provide, operate, protect, improve, and enforce the Services, comply with legal obligations, process payments and payouts, prevent fraud, perform compliance checks, resolve disputes, and protect Redtraffic, Members, users, payment providers, service providers, and third parties.

7.2. We may share personal data with our affiliates, related entities, officers, managers, employees, contractors, representatives, and authorized personnel who need access to such information for business, operational, technical, compliance, support, legal, accounting, security, or administrative purposes.

7.3. We may share personal data with service providers, processors, contractors, vendors, and business partners that support our operations, including hosting providers, cloud providers, database providers, analytics providers, cybersecurity vendors, fraud-prevention vendors, compliance vendors, identity verification providers, KYC/KYB providers, customer support tools, communications providers, email providers, file storage providers, reporting tools, and other technical or operational vendors.

We may share personal data with payment providers, payment gateways, banks, acquiring banks, issuing banks, card networks, payment processors, payout providers, wallet providers, cryptocurrency or stablecoin processors, fraud-prevention providers, chargeback management providers, and other financial or payment-related partners for payment processing, payout processing, refunds, chargeback handling, payment disputes, transaction monitoring, reconciliation, fraud prevention, sanctions/AML screening, and payment-provider compliance.

7.5. We may share personal data with auditors, accountants, tax advisors, legal advisors, insurers, consultants, compliance partners, and other professional advisors where necessary for accounting, audit, tax, legal, insurance, compliance, risk-management, dispute-resolution, or business purposes.

7.6. We may share personal data with regulators, tax authorities, law enforcement authorities, courts, arbitration bodies, government agencies, public authorities, and other competent authorities where required by law, court order, subpoena, regulatory request, legal process, payment-provider rules, card-network rules, or where we reasonably believe disclosure is necessary to comply with legal obligations, protect rights, prevent fraud, respond to unlawful activity, or enforce our Terms and policies.

We may share personal data with Buyers, Sellers, Members, or other participants in the Platform where necessary to provide the Services, deliver advertising, resolve disputes, investigate traffic quality, verify campaign delivery, address complaints, process transactions, or enforce our Terms and policies. We limit such sharing to information reasonably necessary for the relevant purpose.

7.8. We may share campaign, traffic, technical, fraud, payment, payout, compliance, and account-related information with relevant parties where necessary to investigate or respond to invalid traffic, prohibited content, malware, phishing, unauthorized access, technical abuse, chargebacks, payment disputes, fraud, sanctions/AML risk, regulatory inquiries, security incidents, or violations of our Terms, Guidelines, or policies.

7.9. We may disclose personal data in connection with an actual or proposed merger, acquisition, financing, restructuring, reorganization, sale of assets, sale of equity, business transfer, platform transfer, payment migration, assignment, insolvency proceeding, or similar transaction. Where required by applicable law, we will take appropriate steps to protect personal data in connection with such transaction.

7.10. We do not sell personal data for money. We may disclose or make available certain personal data for advertising, analytics, measurement, or platform operation purposes in ways that may be considered “sharing,” “targeted advertising,” or “sale” under certain U.S. state privacy laws. 8.1. Redtraffic may use automated tools, rules, algorithms, fraud-prevention systems, traffic-quality systems, sanctions screening tools, payment-review tools, analytics tools, and similar technologies to help operate, protect, measure, and improve the Website, Platform, Services, campaigns, payments, payouts, compliance processes, and security systems.

8.2. These tools may assist with fraud detection, invalid traffic detection, campaign screening, sanctions/AML screening, payment and payout review, chargeback-risk assessment, security monitoring, ad delivery, targeting, analytics, and service optimization.

8.3. Redtraffic does not intend to rely solely on automated decision-making that produces legal or similarly significant effects on individuals without appropriate human involvement, unless permitted by applicable law.

8.4. Redtraffic may take automated or partially automated action where necessary to protect the Platform, prevent fraud or invalid traffic, stop malware or unauthorized access, comply with legal or payment-provider requirements, reduce chargeback exposure, or respond to security risks.

9. SECURITY OF PERSONAL DATA

9.1. Redtraffic uses reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, loss, misuse, destruction, or unlawful processing.

9.2. These safeguards may include access controls, authentication measures, encryption or similar protections where appropriate, monitoring, logging, secure storage, vendor controls, internal policies, and other security measures appropriate to the nature of the personal data and the risks involved.

9.3. Access to personal data is limited to personnel, contractors, service providers, payment providers, compliance partners, and other authorized parties who need access for business, operational, technical, payment, payout, fraud-prevention, compliance, legal, security, or support purposes.

9.4. No method of transmission, processing, or storage is completely secure. Redtraffic cannot guarantee absolute security of personal data, but we take reasonable steps designed to protect personal data in accordance with applicable law and the nature of our Services.

9.5. If we become aware of a personal data breach or security incident requiring notice under applicable law, we will take steps to investigate, mitigate, and notify affected individuals or competent authorities where required.

10. DATA RETENTION

10.1. We retain personal data for as long as reasonably necessary to provide the Services, operate accounts, process payments and payouts, maintain records, comply with legal obligations, resolve disputes, enforce our Terms and policies, prevent fraud, protect the Platform, and support our legitimate business purposes.

10.2. The retention period may depend on the type of data, the purpose for which it was collected, the nature of your relationship with Redtraffic, account activity, legal requirements, tax and accounting obligations, payment-provider requirements, chargeback risk, fraud-prevention needs, sanctions/AML obligations, audit requirements, dispute-resolution needs, security needs, and potential legal claims.

10.3. We may retain account records, payment records, payout records, tax records, compliance records, verification records, campaign records, traffic records, support communications, and related materials after account closure, suspension, termination, final payout, or final refund where retention is reasonably necessary for legal, regulatory, tax, accounting, audit, fraud-prevention, chargeback, payment-provider, dispute-resolution, security, or legitimate business purposes.

10.4. Where personal data is no longer required, we may delete, anonymize, aggregate, restrict, or securely retain it in accordance with applicable law, technical limitations, backup procedures, record-retention requirements, and our internal policies.

10.5. A deletion request may be subject to legal exceptions. We may retain certain personal data where required or permitted by applicable law, including for fraud prevention, sanctions/AML compliance, tax compliance, accounting, audits, payment disputes, chargebacks, security, dispute resolution, legal claims, or enforcement of our Terms and policies.
